If Soul capture is energetic on a creature whilst it dies, and you have an empty soul gem it is going to slot in, the soul gem would be crammed. Most gems come with weaker level souls in them, which just wouldn't do for the Chameleon Armor. Of course it's open seaon on the Thalmor I can't think of a nicer place to send them to - inside a black soul gem (at last they're usefull).
